1. Introduction
Welcome to Neon Alley Events. These Terms of Service ("Terms") govern your use of the Neon Alley Events website (the "Site") and the services offered by Neon Alley Events (the "Services"). By accessing our Site or using our Services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Site or Services.
2. Service Description
Neon Alley Events provides professional party planning services across Australia, specializing in modern themed celebrations and corporate gatherings. Our team coordinates décor, entertainment, and logistics to deliver memorable and stress-free events.
The specific services we provide include but are not limited to:
- Event concept development and theme creation
- Venue selection and management
- Vendor coordination (catering, entertainment, photography, etc.)
- Event design and décor
- Day-of coordination and management
- Virtual and hybrid event production
3. Bookings and Payments
3.1 Booking Process: All event bookings require a signed contract and initial deposit to secure the date and services.
3.2 Deposits: A non-refundable deposit of 25% of the total event cost is required to secure your booking. This deposit will be applied to your final balance.
3.3 Payment Schedule: Following the initial deposit, 50% of the remaining balance is due 90 days prior to your event, with the final balance due 14 days prior to the event date.
3.4 Late Payments: Late payments may result in cancellation of services and forfeiture of deposits.
3.5 Additional Costs: Any additional services requested after contract signing will be billed separately and require payment before the event date.
4. Cancellation and Rescheduling Policy
4.1 Client Cancellation: In the event of cancellation by the client, the following refund schedule applies:
- Cancellation more than 120 days before event: Forfeit of initial deposit
- Cancellation 60-120 days before event: Forfeit of initial deposit plus 25% of remaining balance
- Cancellation 30-59 days before event: Forfeit of initial deposit plus 50% of remaining balance
- Cancellation less than 30 days before event: No refund available
4.2 Rescheduling: Requests to reschedule must be made in writing. One rescheduling within 12 months of the original date may be accommodated without penalty, subject to availability. Additional rescheduling will incur a fee of 15% of the total event cost.
4.3 Force Majeure: In the event of circumstances beyond our control (natural disasters, government restrictions, etc.), we will work with you to reschedule your event without additional fees, or provide credit for future services if rescheduling is not possible.
5. Intellectual Property
5.1 Content Ownership: All content on our Site, including text, graphics, logos, images, and software, is the property of Neon Alley Events and is protected by Australian and international copyright laws.
5.2 Event Documentation: We reserve the right to photograph and/or record events for promotional purposes unless otherwise specified in writing. Clients grant Neon Alley Events permission to use images and recordings of their events for marketing materials, social media, and our website.
5.3 Client Materials: Clients retain all rights to their own logos, branding, and proprietary materials shared with us for event planning purposes.
6. Privacy and Data Protection
6.1 Data Collection: We collect personal information necessary for providing our Services. Details about data collection practices can be found in our Privacy Policy.
6.2 Data Security: We implement reasonable security measures to protect your personal information. However, we cannot guarantee absolute security of data transmitted over the internet.
6.3 Third-Party Services: Our Services may involve third-party vendors who may have access to your information. We require all third-party vendors to maintain confidentiality and appropriate security measures.
7. Limitation of Liability
7.1 Service Performance: While we strive for excellence in all our events, Neon Alley Events cannot guarantee absolute satisfaction with subjective elements such as décor aesthetics or entertainment quality.
7.2 Vendor Performance: While we carefully select and coordinate with vendors, we cannot be held liable for the failure of third-party vendors to perform their services as promised.
7.3 Damages Limitation: In no event shall Neon Alley Events be liable for any indirect, special, incidental, or consequential damages arising out of or related to your event or our Services. Our total liability shall not exceed the total amount paid for the Services.
8. Indemnification
You agree to indemnify and hold harmless Neon Alley Events, its employees, contractors, and representatives from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of our Services or your violation of these Terms.
9. Modifications to Terms
Neon Alley Events reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our Site. Your continued use of our Services after any changes indicates your acceptance of the modified Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the courts of Victoria, Australia.
